Terms & Conditions

Version 3 · Last updated 30 October 2026

1. About these terms

These terms govern your use of this website and any quotation, order, lay-by agreement or service provided by The Cheff (Pty) Ltd, trading as The Food Business Collective (FBC). The Food Business Collective is a trading division of The Cheff (Pty) Ltd, not a separate company. By submitting an enquiry, placing an order or entering into a lay-by, you agree to these terms. Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other law that cannot lawfully be excluded.

2. Use of the website

You may browse the catalogue, read our guidance material and submit enquiries and orders. You agree to give accurate information and to use the site lawfully. Catalogue content is provided for information and reference.

3. Catalogue, pricing and quotations

Product images and descriptions are shown for reference. Availability, specifications and pricing are subject to confirmation. Prices are in South African Rand and include or exclude VAT as indicated on the product. A quotation is valid for the period stated on it, and is not an offer until we confirm your order.

4. Orders and acceptance

An order is accepted when we confirm it in writing. We may decline or cancel an order where a product is unavailable, where a price or description error is material, or where we cannot verify payment or customer details. If we cancel an order, amounts already received for that order are refunded.

5. Payment

Payment methods and instructions are shown at checkout or on your invoice. Where card payment is offered it is processed by our payment provider, and we do not store full card details. An order is only marked as paid once the payment has been verified on our side.

6. Lay-by agreements

Lay-by agreements are also governed by our Lay-By Terms.

7. Delivery and collection

Delivery and collection are governed by our Delivery and Collection Policy.

8. Installation and commissioning

Many products require professional installation and commissioning. You are responsible for ensuring that the installation site is suitable and that installation is carried out by an appropriately qualified, registered or competent person where legislation, regulations, standards or manufacturer requirements require it. We can provide or assist with installation services where available. Where the law requires it, a Certificate of Compliance or other certification must be issued by the appropriately authorised person. We are not responsible for defects or damage actually caused by incorrect, unauthorised or non-compliant installation by you or a third party, without affecting any right that cannot lawfully be excluded.

9. Warranty

Manufacturer or supplier warranties may apply, depending on the product, and are described in the product documentation or your quotation. A manufacturer warranty is in addition to, and does not replace, your statutory rights. We will reasonably assist you with legitimate warranty claims.

10. Returns and refunds

Returns, refunds and exchanges are governed by our Returns, Refunds and Exchanges Policy.

11. Guidance and recommendations

We provide consultative guidance on equipment selection, application and training in good faith, based on the information you give us and our industry experience. It is not accounting, legal, financial or engineering advice and does not replace advice from an appropriately qualified professional.

12. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss arising from incorrect installation, misuse, inadequate site services or failure to follow manufacturer instructions. Our liability in respect of a product is limited to the remedies available under applicable law and, where applicable, the price paid for that product. Nothing in these terms excludes liability that may not lawfully be excluded.

13. Intellectual property

Content on this website, including text, images, logos and catalogue material, belongs to us or our licensors and may not be reproduced without permission.

14. Privacy

We process personal information as described in our Privacy Policy.

15. Governing law

These terms are governed by the laws of the Republic of South Africa.
